In People v Antommarchi (80 N.Y.2d 247, rearg denied 81 N.Y.2d 759 [decided today]), the trial court questioned 37 of 67 prospective jurors at a sidebar, in defendants absence, about their subjective thoughts on a number of issues. We reversed the conviction stating that while a "court may conduct side-bar discussions with prospective jurors in a defendants absence if the questions relate to juror qualifications such as physical impairments, family obligations and work commitments ... [it] may not ... explore prospective jurors backgrounds and their ability to weigh the evidence objectively unless defendant is present" (80 N.Y.2d, at 250, supra).
